PRESIDENT OF INDIA
Article 52 provides the office of the President of India.
Article 54: Election of the President
The President's election is held in accordance with the system of proportional representation
by means of a single transferable vote and the voting takes place by secret ballot.
The President electoral college consisting of:
(i) The elected members of both the houses of Parliament
(ii) The elected members of the legislative assemblies of the states
(iii) The elected members of the legislative assemblies of the Union Territories of Delhi and Puducherry.
Qualification of the President:
Under Article 58, a person to be eligible for the election of the President should fulfill the following conditions:
(i) He should be a citizen of India
(ii) He should have completed 35 years of age;
(iii) He should be qualified for election member of the Lok Sabha
(iv) He should not hold any office of profit under union government or any local or other authority.
Term of the President:
1 The president holds office for a term of five years from the date on which he enters upon his office. A person who holds, or who has held the office of the President is eligible for reelection to that office.
2. He can resign from his office at any time by addressing the resignation letter to the Vice-President of India.
Oath and Affirmation of the President:
The Oath of office to the President is administered by the Chief Justice of India and in his absence, by the senior most judge of the Supreme Court available.
Impeachment of President of India (Article 61):
1. Article 61 provides that the President may be removed by impeachment from his office on grounds of violation of the constitution.
2.The impeachment charges may be initiated by either house of the parliament and the charges should be signed by 1 / 4 th of the members of the house which framed the charges.
The resolution of the charges should be passed by the majority of 2 /3 rd of its total membership of each houses.
Vacancy in the President's Office:
If the office falls vacant, then election to fill the vacancy should be held within six months from the date of the occurrence of such a vacancy.
Vacancy occurs due to his resignation, removal, death or otherwise. The Vice- President acts as the President until a new President is elected. In case the office of Vice-President is vacant, the Chief Justice of India (or if his office is also vacant, the senior most judge of the Supreme Court available) acts as the President or discharges the functions of the President.
