Part II, Article 5-11 of our Indian constitution deals with citizenship


Acquisition of the Citizenship

The Citizenship act of 1955 talks about acquisition and loss of citizenship

It prescribes five ways of acquiring the citizenship of India 

(i) By Birth 

(ii) By Descent

(iii) By Registration 

(iv) By Naturalization

(v) By Incorporation of Territory


(i) By Birth - A person born in India can obtain the citizenship if he born on or after 26th January 1950

(ii) By Descent- Every person who is born in Foreign country on or after 26th January 1950,shall obtain the citizenship if his or her parents are the citizens of India while the birth of the child

(iii)By Registration - A  non citizen  can apply for the citizenship of India and can get registered a a citizen of India by the prescribed authority by the following ways:

(a) He is a person of Indian origin and has spent 5 years in India 

(b) Foreign woman married to an Indian 

(c) Minor children of Indian parents
